The advertiser, specialist, or agent will receive a brief overview of applicable payments, service terms, and our cancellation policy. To accept these terms and conditions, click the email confirmation link and take affirmative action by checking the "acknowledgment" box and clicking "submit" after reviewing the Terms and Conditions. The offer will be withdrawn if advertisers do not accept the terms and conditions within 30 days of receiving them from Art Wizard Studio. Advertisers can request services from Art Wizard Studio again, but new estimates and terms and conditions will apply.
Suppose the advertiser chooses not to be legally bound. In that case, they must notify Art Wizard Studio within three working business days by emailing support@artwizardstudio.com with their name, business name, email address, physical or street address, and location, using "Cancellation of Services" as the subject line. The services will be canceled without any further obligations as long as the notification is sent before 5 PM US Eastern Standard Time. The advertiser bears responsibility for any costs related to the services. However, if the advertiser fails to email or communicate with Art Wizard Studio regarding the cancellation of services, in that case, it will be assumed that all terms and conditions have been accepted, and the contract will legally bind the advertiser.
Upon acceptance of the terms and conditions, the advertiser consents to receiving communications from Art Wizard Studio regarding their account and the services rendered. These communications may include promotional messages, technological advancements updates, or supplementary offers. To unsubscribe from promotional or marketing messages, the advertiser can email support@artwizardstudio.com with the subject line "Opt-out of Marketing Messages," ensuring their name is included.
Irrespective of the advertiser's acceptance of these Terms and Conditions, any personal information provided by the advertiser will be governed by Art Wizard Studio's privacy policy, which is available for review.
If the advertiser shares their contact information with Art Wizard Studio but explicitly rejects or fails to approve these Terms and Conditions within thirty (30) days. In that case, the services will not be rendered. If the services were provided previously, they would be terminated or canceled accordingly. In such instances, the advertiser may still receive marketing messages from Art Wizard Studio. To unsubscribe from these messages, the advertiser can follow the abovementioned process.
Please be aware that requests to unsubscribe, per the terms specified in this section, may need a certain amount of processing time by Art Wizard Studio. Therefore, the advertiser may continue to receive messages during the processing period.
Art Wizard Studio provides a range of online marketing strategies and website promotion services to advertise advertisers' businesses effectively. These services are considered our products.
The following are the existing offerings of "Services," which are subject to change periodically. These Terms and Conditions solely apply to the Services that the advertiser has requested, paid for, and are provided by Art Wizard Studio:
Each Service contains marketing and advertising practices specific to that service, as elaborated in the corresponding link. The terms and conditions associated with each service exclusively apply to that service and do not extend to any other services offered by Art Wizard Studio. The individual terms and conditions for each service will be regarded as an integral part of these General Terms and Conditions for the services procured by the advertiser at any time.
Furthermore, alongside the provision of the Services, Art Wizard Studio will give the advertiser an Account Information Page accessible at any time to verify the status of their account and the services rendered. Additionally, the advertiser can inquire about the current services provided through calls, chats, or emails.
The advertiser should acknowledge that clicks to their website, including those originating from search engines, shopping engines, content sites, and others, may include spelling errors, variations in singular or plural forms, and related search terms associated with their advertising campaign. It is important to note that spelling errors are common in the current autocomplete search engine technology era. All keyword campaigns will be developed to optimize the return on advertising investment by carefully selecting key terms, titles, and descriptions.
Unless the advertiser has specifically engaged Art Wizard Studio to create a microsite, they bear responsibility for the quality and accuracy of their website, landing pages, or redirect sites linked to their advertisements.
The advertiser can establish the expenses and pricing for any service by conveying their preferences through phone, chat, or email. As mentioned earlier, the charges associated with the services are detailed in the respective terms and conditions pages for each product or service. By accepting these terms and conditions, the advertiser expressly agrees to fulfill the payment obligations for the requested services as communicated to them at or prior to the time of acceptance.
The advertiser is required to select one of the following payment methods: a credit card, which will be charged by Art Wizard Studio, or a bank cheque made payable to Art Wizard Studio. By accepting these terms and conditions, the advertiser grants authorization to Art Wizard Studio or its Art Wizard Studio services provider to securely store their financial information to facilitate payment. The advertiser's responsible for notifying Art Wizard Studio in writing of any changes or updates to their financial information.
All payments should be in USD, and the advertiser assumes full responsibility for any applicable taxes. The expenses are due as per the agreed-upon payment schedule or immediately upon receipt of the invoice, as appropriate. The advertiser acknowledges that any setup fees or one-time service payments are non-refundable.
Credit card or bank account payments are processed to ensure timely payments and avoid any inconvenience. However, the advertiser must keep their credit card or bank account information current and ensure that the chosen payment methods are appropriate for covering expenses owed to Art Wizard Studio for their services.
Late fees will be applicable in the event of a payment failure using the approved payment method provided by the advertiser, resulting in overdue payments. The late fee will be a minimum of $150 or 10% of the total amount due, whichever is greater, up to the maximum amount allowed by applicable law. Additionally, the advertiser agrees to bear all attorneys' fees and expenses incurred by Art Wizard Studio to collect late payments.
If the advertiser desires to choose the contract term or obtain information regarding recurring payments, including amounts and expected dates, or details about the duration, termination, or renewal of the services, they can request such information via phone, chat, or email.
The duration of each service will begin from the date when the advertiser accepts these terms and conditions. Billing will occur either as a one-time payment or as per the specified payment schedule outlined in the specific terms and conditions of the product or service provided.
All service fees are to be paid in advance monthly. After the initial contract term for a specific service, the contract will automatically renew every month, coinciding with the anniversary date of the advertiser's initial acceptance of these terms and conditions.
Upon completion of the initial contract term, the advertiser has the option to cancel the automatic recurring payment and associated services. To cancel, the advertiser must email Art Wizard Studio with their name, business name, email address, phone number, physical location, and area, using "Cancel Service" as the subject line. To ensure successful cancellation, the email must reach Art Wizard Studio by 5:00 PM US Eastern Standard Time, at least three business days before the next recurring payment date. In such a case, the subsequent regular payment will be canceled, and the services will conclude at the end of the current term.
If the cancellation notice is received less than three business days before the next recurring payment, the payment will still be processed, and the services will continue for an additional renewal term. The cancellation will take effect at the end of that other renewal term.
No pro-rated refunds will be issued for partial terms or months. For instance, if an advertiser enters into a 365-day contract term with Art Wizard Studio, with the initial sign-up date being July 15 of a given year, to cancel the services at the end of the agreement term without incurring an extra month's charge, the advertiser would need to provide written cancellation notice no later than July 12 (assuming July 12, 13, and 14 are business days). On the other hand, one-time charge offerings do not have subsequent terms as they are provided in advance, and their duration is fulfilled upon the initial delivery of the service to the advertiser.
If an advertiser terminates the services before the agreed contract term is completed, they will be subject to an early termination fee equivalent to the remaining Contract Value. The Contract Value is calculated by multiplying the months already fulfilled in the agreement or service request by the monthly expenses associated with the services. For instance, if the services have a three-month term and the Contract Value is $2500, with a monthly cost of $850, if the advertiser cancels after the first month, the early termination fee will amount to $1250.
The advertiser acknowledges that Art Wizard Studio may update its standard terms and conditions and service offerings periodically. Art Wizard Studio reserves the right to modify the pricing of services, providing the advertiser with written notice at least thirty (30) days in advance. The contract will be considered month-to-month if the agreement does not allow for renewal or extension beyond one month. Consequently, the advertiser will be subject to revised terms, conditions, and pricing upon receiving the notice. It is recommended that the advertiser consider entering into longer-term contracts to secure pricing, terms, and conditions. Any service changes will be made through mutual agreement between the advertiser and Art Wizard Studio.
The advertiser can access Art Wizard Studio's websites, which may require login or account information to manage their advertising account(s). The advertiser needs to use the site and its content responsibly and not misuse or distribute confidential information. Creating an account with Art Wizard Studio is strictly for personal use and cannot be transferred to others. The advertiser must adhere to Art Wizard Studio's rules and guidelines. Additionally, using automated scripts, robots, or spiders to access their account or monitor Art Wizard Studio's website and content is prohibited, except when provided explicitly by Art Wizard Studio's automated tools.
The advertiser acknowledges that the data or statistics they provide to Art Wizard Studio may not be processed in real-time and could experience delays due to factors such as internet latency, Art Wizard Studio's systems, and the systems of third-party partners and search engines.
Art Wizard Studio retains full ownership rights and title to the Services, which includes all related concepts, ideas, campaign optimizations, computer programs, and other technology associated with Art Wizard Studio's operations, bid management, task management, optimization platform, and websites (collectively referred to as "Art Wizard Studio Materials"). This ownership extends to outsourced suppliers, authors, and promotional partners, provided they are the rightful owners. The advertiser acknowledges that they do not gain any ownership interest in Art Wizard Studio Materials through this agreement.
Suppose the advertiser's website is not explicitly created and provided by Art Wizard Studio as part of its services. In that case, the advertiser acknowledges that Art Wizard Studio and its promotional partner (if applicable) are not responsible for developing, supporting, and operating the advertiser's website(s). This includes any content or materials displayed on the website(s) and visitor-related issues. Art Wizard Studio or its promotional partner also has no control over activities such as order entry, payment processing, shipping, cancellations, returns, or customer service associated with orders placed on the advertiser's website(s). The advertiser also agrees not to include or display any content owned or licensed by Art Wizard Studio or its promotional partner or any Art Wizard Studio search listings unless there is a specific agreement with Art Wizard Studio.
The advertiser affirms and assures Art Wizard Studio and its promotional partner, if applicable, that during the entire term of this agreement:

The advertiser acknowledges and agrees to the following commitments:
The advertiser agrees to protect, defend, and hold harmless Art Wizard Studio, its delivery partners (including the promotional partner), their licensors and licensees, affiliated companies, and their officers, directors, employees, representatives, and agents (collectively referred to as the "Indemnified Parties"). This means that the advertiser will cover all costs, including reasonable attorney's fees, and protect the Indemnified Parties from any claims, lawsuits, or proceedings that may arise from various reasons, such as defamation, invasion of privacy or publicity, copyright or trademark infringement, fraud, false advertising, misrepresentation, product liability, violation of laws, or breach of any term or agreement related to the services provided to the advertiser, the advertiser's website(s) or content, the advertiser's actions or omissions, or any breach of the terms and conditions outlined in this agreement.
The advertiser will not be held responsible for any claims or demands arising solely from the acts or omissions of an Indemnified Party. If an Indemnified Party requires indemnification, they will inform the advertiser. The Indemnified Party has the sole discretion to accept or reject the law firm the advertiser chose to defend them. The advertiser cannot settle any claim related to the liability of an Indemnified Party without their prior consent. An Indemnified Party has the right to defend a claim and be represented by their chosen counsel at their own expense. Under applicable law, Art Wizard Studio has the right to offset any liability of the advertiser concerning a claim using any deposited amount held by Art Wizard Studio.
The advertiser accepts that Art Wizard Studio and the promotional partner assume no liability for any content errors, omissions, consequences, damages, costs, refunds, or issues arising from service interruptions or the unavailability of the Internet or the websites where the advertisements are displayed, for reasons unknown.
Additionally, the advertiser acknowledges that any errors or mistakes in the execution of the Services, such as spelling errors or miscommunication, will not entitle them to a refund. The advertiser agrees to promptly notify Art Wizard Studio of any identified errors or omissions and provide a reasonable time for corrections. Art Wizard Studio relies on third parties for specific information; therefore, no guarantees are made regarding such information's accuracy, quality, or completeness. If applicable, neither Art Wizard Studio nor the promotional partner will be held liable for any consequential, extraordinary, lost profits, or other damages arising from this Agreement.
If the advertiser requests or acquires additional assistance, such as tracking codes or website modifications related to the Service, the advertiser agrees to grant Art Wizard Studio the required access to carry out the requested or purchased additional assistance. The advertiser understands that any further assistance provided by Art Wizard Studio is also subject to the limitations of liability outlined in this Agreement.
Exclusive Venue: This Agreement shall be governed and construed by the laws of the United States of America, and the parties mutually agree that any disputes arising from this Agreement shall be exclusively resolved in a court of competent jurisdiction located within the United States of America.
The headings used in this Agreement are for convenience only. They shall not be deemed to modify or affect the interpretation or enforceability of the Agreement or any of its provisions.
If either party waives a breach of any provision in this Agreement by the other party, such waiver shall not be considered a waiver of any subsequent breaches of the same or any other provision. Each breach or default shall be treated as a separate and distinct occurrence, and the waiver of one breach or default shall not be deemed a waiver of any other breach or default.
This Agreement, together with all referenced materials, documents, understandings, or agreements, and any attached exhibits, schedules, or supplementary documents, constitute the entirety of the contract and Agreement between the parties. All prior agreements, understandings, or representations are now terminated and shall have no further force or effect.
In the event of a dispute between the parties, the party that prevails in such dispute, regardless of whether a court decision is rendered, shall be entitled to recover its reasonable attorneys' fees and costs incurred from the non-prevailing party.
The contracts, commitments, and agreements specified in this Agreement are exclusively for the benefit of and enforceable by the parties involved, including the promotional partner where indicated. They shall extend to their respective successors or authorized assigns.
Sections of this Agreement that relate to matters or conditions that may arise after the termination of this Agreement shall remain binding and enforceable.
Our content policy is crucial in ensuring a positive client experience. For regular websites and resume designs, the client will be responsible for providing all content, including images, headings, copy, and text. In the case of resume design, clients are expected to provide their complete personal information and biography, as we do not offer content services in that area.
Regarding e-commerce websites, our Art Wizard Studio team will provide 10 to 30 sample products. However, the client will be responsible for supplying product information such as product name, price, images, and shipping policy. Art Wizard Studio will manage CMS (Content Management System) and e-commerce.
We may use dummy text (Lorem Ipsum) in graphics during the design process to showcase layouts and visual mockups.
Our designers diligently adhere to your precise specifications and requirements throughout the design creation process to ensure your utmost satisfaction. We conduct thorough research and meticulous scrutiny to uphold our designs' exceptional quality and distinctive nature. Our unwavering commitment to your contentment is exemplified by our provision of unlimited revisions, ensuring your complete satisfaction. We persistently refine the design until it surpasses your expectations and delights you with the outcome. Additionally, if required, we offer complimentary coordination with your chosen printing company, streamlining the process from design to production for your convenience.
All design order files are delivered to your Account Area on the specified date mentioned in the "Order Confirmation." An email notification will also be sent to you, informing you that your design order has been delivered to your designated account area. Please be aware that any revision or refund procedures are dependent on the date and time of delivery to your account area.
The delivery timeframes for our preliminary customized design orders are as follows: logos, websites, and branding materials are typically delivered via email within 2 to 3 days. In the case of software, apps, mobile games, and animation storyboards, the delivery timeframe generally is 3 to 5 days. However, the delivery time for digital marketing strategies may vary based on research, mediums, budget, and overall project scope.
Art Wizard Studio values client satisfaction and provides unlimited revisions based on the chosen package. Clients can request revisions within their package without any additional charges. However, the overall design concept will remain consistent, and clients can provide feedback for revisions on the options provided. Please note that edits for multiple options may not be permitted or may incur separate fees. The typical turnaround time for logo and website design revisions is 48 to 72 hours, while video animations require 3 to 5 days. For software, apps, and game revisions, the timeline may vary depending on the extent of the changes. Similarly, the functionality and development revisions timeframe is contingent upon the project scope. Revising a digital marketing strategy will rely on research, mediums, budget, and the overall plan size.
Upon full payment and delivery of the final file, the client gains exclusive ownership of all rights to the paid artwork. This ownership encompasses all claims and copyrights associated with the artwork, granting the client complete control and legal license of the design.
The client wholly owns the logos, drafts, and related materials. The Website, however, reserves the right to use the logos solely for promotional purposes, such as displaying them in our portfolio. The logos will not be sold or used for profit unless explicitly authorized by the client. The client can utilize the design, graphics, logos, and text as they see fit. The Website guarantees to use the logos fairly and legally, upholding the client's reputation and integrity.
Upon delivering the final files, we keep a record of your completed design. If you need the files again in the future, let us know, and we'll provide them upon request. Data is stored for 6 months, after which files are permanently deleted.
You acknowledge that communication received from email addresses or toll-free numbers not associated with our domain, specifically "support@artwizardstudio.com" or any toll-free number mentioned on our website, is not the responsibility of Art Wizard Studio. Art Wizard Studio cannot be held liable for any damages from such communication. We assume responsibility only for communication through email addresses under our domain or via the toll-free number specified on the Art Wizard Studio website.
